Definition and Authorization
Deadly force refers to any force that a reasonable person would consider likely to cause death or serious bodily injury. The Department of Justice authorizes the use of deadly force when FBI agents encounter situations involving imminent threats to their lives or the lives of others.
Recent Developments
Assembly Bill 392 (AB 392) in California now requires the use of deadly force to be necessary when an officer is making an arrest, conducting an investigatory stop, or engaging in other law enforcement duties. However, concerns have been raised about the potential for excessive force, both deadly and non-deadly, in these contexts.
